1. Acceptance of Terms
By accessing and using the Excersys website and services, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our services.
2. Services
Excersys provides custom software development, cloud architecture, AI & machine learning, mobile development, digital transformation, and team augmentation services. The specific terms, deliverables, and pricing for each engagement are defined in separate project agreements.
3. Intellectual Property
Unless otherwise specified in a project agreement, all intellectual property rights in deliverables created by Excersys shall transfer to the client upon full payment. Excersys retains the right to use general knowledge, skills, and experience gained during the engagement.
4. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This obligation survives the termination of any agreement between the parties.
5. Limitation of Liability
To the maximum extent permitted by law, Excersys shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Los Angeles County, California.
7. Changes to Terms
Excersys reserves the right to modify these terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page.
